The ban applies to all products, regardless of whether they are imported or produced within the EU for domestic consumption or for export. The regulations will apply from 14 December 2027. The Forced Labour Directive was not taken up by the omnibus procedures. It continues to apply unchanged. You can find the European Commission&#8217;s website <a href=\"https:\/\/single-market-economy.ec.europa.eu\/single-market\/goods\/forced-labour-regulation_en?prefLang=de\">here<\/a>, and the Regulation <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=OJ:L_202403015\">here<\/a>.<\/p>\n<h3><strong>What is the timeline for implementation?<\/strong><\/h3>\n<p>The next step is to designate the authorities responsible in the respective EU member states. The publication of &#8220;databases and guidelines&#8221; for practical implementation is expected from summer 2026. The regulation will enter into force on 14 December 2027.<\/p>\n<h3><strong>Why is this important now? <\/strong><\/h3>\n<p>Even if the regulation does not come into force until the end of 2027, it will be too late to react.<br \/>\nFour reasons why you should act now:<\/p>\n<ul>\n<li>30-day deadline for enquiries from authorities: if an authority audits your supply chain, you must provide evidence of your risk analysis and implementation of due diligence obligations within 30 working days. A documented system cannot be set up last-minute, it needs time.<\/li>\n<li>Not just Tier 1: Unlike the CSDDD, the EU FLR requires a risk analysis across the entire supply chain &#8211; not just for direct suppliers. This transparency requires time, data and systematic processes.<\/li>\n<li>Your existing system is your head-start: The risk analysis that you already carry out with Trustnet.Trade covers the central requirements of the EU FLR: Country risks, industry risks, supplier assessment. This foundation now needs to be expanded in a targeted manner.<\/li>\n<li>No threshold &#8211; every company affected: The EU-FLR recognises no turnover or employee limits. Whether SME or corporation &#8211; anyone who sells, imports or exports products on the EU market is affected.<\/li>\n<\/ul>\n<h3><strong>What is the definition of forced labour?<\/strong><\/h3>\n<p>Forced labour is defined by the <a href=\"https:\/\/www.ilo.org\/topics-and-sectors\/forced-labour-modern-slavery-and-trafficking-persons\">International Labour Organization (ILO)<\/a> as &#8220;any work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily&#8221;. It refers to situations in which people are forced to work through violence, intimidation, manipulated debts, retention of identity documents or threats of denunciation to authorities.<\/p>\n<h3><strong>Which stages of the value chain and products are affected by the regulation?<\/strong><\/h3>\n<p>The ban on products made using forced labour applies to products where forced labour was used at any stage of the production, manufacture, harvesting or extraction of these products, including in the treatment or processing of these products. The prohibition of products made with forced labour should apply to all products of any kind, including their components, irrespective of the sector and origin, whether they are domestic or imported, and whether they are placed or made available on the Union market or exported from the Union market. This Regulation does not apply to the provision of transport services. Pure non-product related services (e.g. consultancy) are excluded, but services with a product component (e.g. hardware supply) are covered by the ban.<\/p>\n<h3><strong>How do I recognise forced labour?<\/strong><\/h3>\n<p>The International Labor Organisation (<a href=\"https:\/\/www.ilo.org\/topics-and-sectors\/forced-labour-modern-slavery-and-trafficking-persons\">ILO<\/a>) has developed indicators to identify and highlight cases of forced labour, such as Threats or actual physical or sexual harm, exploitation of vulnerability, exploitative working and living conditions and excessive working hours, deception, restriction of movement or confinement to the workplace or a limited area, isolation, debt bondage, withholding of wages or excessive reduction of wages, withholding of passports and identity documents or threat of reporting to the authorities if the worker has an irregular immigration status. Forced labour is very often linked to poverty and discrimination. The manipulation of credit and debt, either by employers or by recruiters or labour brokers, is still often a key factor in trapping vulnerable workers into forced labour.<\/p>\n<h3><strong>What happens if forced labour is suspected in my products?<\/strong><\/h3>\n<p>Import, export and purchase\/sale ban: the products can no longer be imported or exported and may no longer be sold within the EU.<\/p>\n<h3><strong>What are my due diligence obligations?<\/strong><\/h3>\n<ul>\n<li>The EU-FLR applies to all economic operators, i.e. in principle to every company that distributes (buys, sells), imports or exports products on the EU market. The Forced Labour Regulation does not have any turnover or employee thresholds. Pure services without product reference (e.g. consulting) are exempt, but services with a product component (e.g. hardware delivery) fall under the ban.<\/li>\n<li>Risk-based due diligence: Companies should review their supply chains with regard to forced labour and carry out systematic risk analyses (especially for high-risk products, regions and sectors).<\/li>\n<li>Integration of existing due diligence obligations: The regulation does not enshrine any new due diligence obligations alongside existing EU or national law (e.g. LkSG, CSRD, CSDDD) but uses these as a reference framework for expected levels of due diligence.<\/li>\n<li>Processes and documentation: A documented due diligence system is expected that includes risk analyses, tailored measures (audits, training, supplier agreements), monitoring and complaints mechanisms.<\/li>\n<li>Compared to the current LkSG, the expectation of the risk analysis from the Forced Labour Regulation goes beyond the direct suppliers in the supply chain, i.e. the risk analysis is not limited to the direct suppliers, but always includes all suppliers involved in the supply chain (risk-based approach).<\/li>\n<li>In the event of official enquiries, proof of the implementation of the due diligence obligations and the result of the risk analysis and measures must be provided within 30 working days.<\/li>\n<\/ul>\n<h3><strong>What supporting measures is the EU planning?<\/strong><\/h3>\n<p>The EU is planning<\/p>\n<ul>\n<li>a public database containing indicative information on forced labour risks in certain geographical areas or products.<\/li>\n<li>Implementation guidelines for economic operators, competent authorities and stakeholders to better understand and comply with the Regulation.<\/li>\n<li>A central information point for reporting suspected violations of forced labour.<\/li>\n<li>the single portal on forced labour to display relevant information for the implementation of the Regulation.<\/li>\n<li>SME support measures to support small and medium-sized enterprises.<\/li>\n<li>International cooperation on the exchange of information and best practices on forced labour risks with non-EU countries and international organisations.<\/li>\n<li>An Information and Communication System for Market Surveillance (ICSMS) &#8211; The forced labour module of this tool enables case management of investigations.
